Terms and Conditions
By ordering a commissioned item or items, you are entering into a legally binding contract with Miranda (Ranny) Insole. These Terms and Conditions govern and protect both you (the commissioner) and the artist (Ranny Insole).
Terms of reference used within these Terms and Conditions:
‘You’ and ‘Your’ - the commissioner
‘The artist’ - Ranny Insole (or their approved legal representative)
‘Project’ - the commissioned artwork
Minimum rate: 1 hour. Time is calculated by the whole hour. More than 20 minutes will be rounded up to the whole hour. Less than 19 minutes will be rounded down to the whole hour.
Personal work £14 p/hr
Commercial work/Distribution rights £28 p/hr
Estimates and Quotes
Estimates are given based on the artist’s assessment of the expected time taken to complete the project. Estimates do not include time for revisions, alterations, retouches or additional requests. The final cost will be based on the hours taken to complete the whole project, and therefore may differ considerably from the Estimate. Anticipated additional costs will be notified to you as part of the ongoing project.
Quotes are only given for basic reproduction project(s), where no significant changes are requested. If you subsequently require any revisions, alterations, retouches or if you make additional requests, you will receive a revised quote before the project continues.
Once the artist has determined the viability of your project, they will supply either a quote or an estimate. The artist will confirm and accept the project once you have agreed
The artist requires a minimum of 28 days to complete a project. This will be from confirmation and acceptance of project.
The artist will work with you in order to meet any deadline.
Any revisions, alterations, retouches or additional requests you make may adversely affect the project completion time, for which the artist accepts no responsibility or liability.
Delays in responding to queries from the artist may also adversely affect the project completion time, for which the artist accepts no responsibility or liability.
In the event the artist is unable to meet an agreed deadline, you will be informed at the earliest opportunity.
A watermarked low resolution draft will be sent to you for your approval (subject to revisions/alterations). You will need to either confirm your Final Approval of the project, or return the draft with details of any revisions, alterations, retouches or additional requests required. Drafts may not be used, reproduced or sold in any form or format, other than to complete the original project. Any drafts received must be deleted and/or destroyed at the end of the contract.
Payment is due on Final Approval and must be received before the completed project is released to you.
If either you or the artist declares the project to be terminated prior to Final Approval, you will be invoiced for the time taken to that point.
A 50% charge will be made at every 10 hours of project time, which must be paid before progression.
The full and final invoice will show any amount(s) already paid.
For tax and National Insurance purposes, the artist is an Independent Contractor and may not be regarded as, or referred to as your employee, agent, or partner.
Intellectual Property Rights and Copyright
The artist receives in good faith and accepts no responsibility or liability for any material you provide, which may, at any time, be subject to another artist or company having Intellectual Property Rights or copyright or trademark over such material. This includes requests for official franchise characters.
You must not remove, obscure or disguise any watermark. You must not claim the artist’s work as your own, nor may you reproduce or sell it in any form without written consent from the artist.
The artist retains the Intellectual Property Rights of any work produced by the artist, and is entitled to consultation and payment of royalties for any subsequent benefit or financial gain arising from the sale, promotion or use of artwork produced by the artist. Copyright remains with the artist. In all instances of publication, whether for personal or financial or other reason, the artwork must be attributed to the artist.
Any ideas, inventions, or innovations arising during the course of carrying out the project are the sole property of the artist. Such property may be transferred or shared only at the artist’s discretion.
You must not use, or allow to be used, personal commissions for commercial purposes.
You will not modify the image in any way other than to crop for purposes such as icons and display pictures. This also includes, but is not limited to, colouring sketches either yourself or via another artist.
In accordance with EU laws, any data collected will not be given out to any and all third parties. All data submitted is for the specific purpose of communication regarding commission work only.
You will not remove any credits and links if reblogged.
You have obtained permission regarding characters involved that you don’t own, if applicable.
The artist reserves the right to refuse any commission or commissions.
The artist reserves the right to display the work completed for promotional purposes.
During streams, you will not harass or abuse either the artist or other viewers.
During streams, you will not provide outside links to other artists, other streams and unrelated content without permission. Other exclusions apply and may be enforced at the artists’ discretion
The order will be processed after the service is rendered.
Terms and Conditions, and Terms of Service, may be subject to amendment at any time
